A more useful question than whether resale should be allowed or not is how tickets are designed and sold in the first place, which practices in the secondary market genuinely need regulating, and what both of these mean for brands that put their name on the line.

Concerts Have Become an Economic Sector, and Brands Are Already Inside It

LPEM FEB UI research found that the economic impact of concerts extends well beyond ticket value, with spillover patterns that differ from country to country (Revindo et al., 2024). In Indonesia, that impact is concentrated in the arts, entertainment, and recreation services sector. In Singapore, the impact of the same kind of concert spreads across more sectors, and Coldplay's six-day run there is estimated to have generated around Rp4.6 trillion in new economic output.

Singapore positions large-scale concerts as part of its tourism strategy. The Singapore Tourism Board (2026) recorded record tourism receipts of SGD 32.8 billion in 2025, up 10 percent from SGD 29.8 billion in 2024. During parliamentary budget debates, the Ministry of Trade and Industry cited the Lady Gaga concert, alongside the World Aquatics Championships, as contributors to that performance (Ministry of Trade and Industry Singapore, 2026a).

For marketers, two things follow from this. First, this scale explains why live events have become such a contested activation channel, and why a single event can absorb a substantial share of sponsorship budgets. Second, as concerts grow into an economic sector and a source of tax revenue, government enters the picture as a stakeholder, and a ticket market once left to organizers begins to become a matter of public concern. These two shifts converge at a single point: how the ticket market actually works.

When Demand Outstrips Supply, a Secondary Market Forms

Ticket supply is fixed and cannot be expanded once venue capacity is filled. Demand, meanwhile, moves with an artist's popularity, while official prices are set in advance and do not fully adjust to demand spikes.

From this gap between the official price and the price some consumers are willing to pay, an opportunity for economic rent opens up in the secondary market — profit derived from controlling a scarce good. The existence of that opportunity does not in itself mean every resale harms consumers, and the data currently available in Indonesia is not sufficient to measure how large that gap is or who captures it.

What can be established is where the tension lies. This gap is felt first by concertgoers — in tickets that sell out within minutes, resale prices that spike, and the risk of fraud. That experience bleeds into the whole event, including the brand whose name sits on the stage and throughout the purchase journey.

Not All Resale Is the Same

The term "scalper" (calo) lumps together practices that differ economically and legally. Distinguishing between them matters for regulators, and matters just as much for brands assessing an event's health, because each type calls for a different response.

Consumers who change their plans. Selling a ticket they already bought to someone else. The economic function is clear and the harm is minimal, as long as the price is fair and the ticket is genuine.

Small-scale resellers. Buying a few more tickets than they need and reselling them at a margin.

Scalpers or professional resellers. Buying tickets from the outset with the primary goal of reselling them. This activity adds to demand the moment sales open and can reduce other consumers' chances of getting tickets at the official price.

Bot-assisted bulk purchasing. Turning the purchase queue into a technical contest, so that access ends up determined by software capability.

Official resale channels. Housing the resale function within a system verified by the organizer, with traceable prices and identities.

A policy that treats all five identically risks eliminating a beneficial function while still failing to touch the practices that actually cause harm. The same logic applies when marketers assess an event: a busy secondary market is not automatically a problem — what matters is reading its shape.

Other Countries Are Intervening at Different Points

The following five jurisdictions are frequently compared in ticket-policy discussions, and together they illustrate the range of directions a market can take. The difference lies in where each one intervenes.

Singapore has chosen not to ban resale. On 5 May 2026, the Ministry of Trade and Industry affirmed that government policy does not prohibit the resale of goods and services, including concert tickets, choosing instead to focus on unfair trade practices and fraud (Ministry of Trade and Industry Singapore, 2026b). On the proposed anti-bot legislation, MTI judged such rules difficult to enforce, since bot technology evolves quickly and its operators are often based outside Singapore's jurisdiction. The government instead pointed to organizer-led measures, such as printing the buyer's name on the ticket and checking identity at entry, as more practical mechanisms.

Japan bans resale, with scope defined by ticket design. A law in force since 2019 prohibits the unauthorized commercial resale of certain tickets above their original price without the organizer's consent, carrying penalties of up to one year in prison or a fine of up to one million yen (Act No. 103 of 2018). The ban applies only to tickets meeting three conditions at once: the organizer states a prohibition on paid transfer on the ticket, the date and venue are fixed with a named attendee or numbered seat, and the organizer verifies the buyer's name and contact details at the point of transaction. Enforcement proceeds case by case with organizer support, as seen in the referral of one resale suspect involving Takarazuka tickets in March 2026 (Hankyu Takarazuka, 2026) and the arrest of one suspect linked to Gekidan Shiki tickets on 9 September 2026 (Shiki Theatre Company, 2026).

The UK has two layers of policy at different stages. On 19 November 2025, the UK government announced plans to ban resale above face value plus unavoidable fees, cap platform service charges, and prohibit individuals from reselling more tickets than they are entitled to buy (Department for Culture, Media and Sport & Department for Business and Trade, 2025). As of September 2026, that plan remains a bill, having entered the King's Speech on 13 May 2026 and now going through pre-legislative scrutiny (Slaughter and May, 2026). What is already in force is transparency enforcement: on 23 June 2026, the Competition and Markets Authority fined StubHub UK GBP 889,200 and ordered refunds of more than GBP 590,000 to 51,350 consumers for displaying mandatory fees only at the final stage of checkout, as reported by Music Business Worldwide (2026).

Victoria regulates resale prices. Reselling above 10 percent of the purchase price is an offense, and resale advertisements must state the original price, the resale price, and seat details (Department of Jobs, Skills, Industry and Regions Victoria, 2025a). The rule applies only to government-declared events, and the official 2026 and 2027 lists are dominated by sporting events, with very few concerts included (Department of Jobs, Skills, Industry and Regions Victoria, 2025b).

South Korea has expanded its scope gradually. A revision to the Performance Act in force since 22 March 2024 banned buying tickets using macro programs for resale purposes, with penalties of up to one year in prison or a fine of up to 10 million won, as reported by The Korea Herald (2024). That rule left a gap, since it only caught tickets bought via macros, leaving manual bulk purchasing outside its reach. An amendment passed on 29 January 2026 and enforced from 28 August 2026 removed the macro requirement, now catching improper resale regardless of whether macros were used, and added administrative penalties of up to 50 times the sale value, as reported by The Korea Herald (2026). Buyers who manipulate or disrupt the normal purchase process in order to resell are now exposed to the same penalties. One gap remains: transactions conducted entirely by foreign nationals outside Korea fall outside the reach of Korean law.

Japan and Victoria both narrowed their rules' scope — to specific ticket categories and to specific listed events respectively — making those rules more enforceable. South Korea took the opposite path, expanding scope and raising penalties, and now faces enforcement challenges and cross-jurisdictional gaps. The choice between narrowing for enforceability and broadening for coverage is a defining design decision.

Indonesia Already Has Rules, but Their Scope Isn't Yet Specific

Government is already part of the concert ecosystem through fiscal instruments. Jakarta's Bapenda recorded roughly Rp14 billion in Specific Goods and Services Tax revenue from arts and entertainment services tied to music concerts through 13 November 2025, up from about Rp7 billion over the same period in 2024, as reported by Bisnis Indonesia (2025). The rate dropped from 15 percent for internationally classed performances under Jakarta Regional Regulation 3/2015 to 10 percent under Jakarta Regional Regulation 1/2024, following the maximum ceiling set by Article 58(1) of Law 1/2022.

Rules touching consumers directly also exist. The new Criminal Code, Law 1/2023, in force since 2 January 2026, addresses fraud through Article 492 and document forgery through Article 391, whose elucidation covers tickets or admission passes. Law 8/1999 on Consumer Protection governs obligations around accurate information and business actors' liability for damages. The Ministry of Trade oversees organizers and platforms, including summoning promoters, ticketing platforms, and promoter associations in May 2025 to follow up on consumer complaints, as reported by Warta Ekonomi (2025).

These instruments operate on harm that has already occurred, mostly in the form of fraud, and the available data follows the same pattern. PPATK recorded 119 concert-fraud-related cases in 2022 with suspicious transaction value of Rp735 million, 180 cases in 2023 worth Rp3.1 billion, and 182 cases in 2024 worth Rp2.3 billion, as reported by Kompas.id (2025). A common reading jumps straight from 2022 to 2024 and concludes there's been a sharp surge, when in fact the full series shows the case counts for 2023 and 2024 are nearly equal, even as the transaction value fell. This figure measures reported suspicious transactions tied to fraud, so it does not yet capture the broader issue of consumer access to tickets at official prices. YLKI reported that consumer complaints related to concerts peaked in 2024, with the number approaching a thousand reports, and noted that no dedicated legal framework yet governs concert organization, as reported by Kompas.com (2026).

What's still missing is a public framework governing how tickets are allocated — from purchase limits and buyer verification to bot prevention and official resale channels. The National Consumer Protection Agency points to the ban on commercial transfer written into promoters' terms and conditions as the main existing safeguard, which means protection at this point rests on private contracts, as reported by Infonasional (2026).

How Tickets Are Sold Determines the Room for Regulation in the Secondary Market

The experiences of Japan and Victoria point to one pattern relevant to Indonesia. Before debating rules for the secondary market, three questions matter first, in the primary market. Is the number of purchases limited? Can tickets be tied to the buyer's identity? Is there an official channel for reselling tickets?

The answers determine whether secondary-market rules can even be verified. A ban on reselling above a certain price is hard to enforce on tickets that change hands untracked, as shown by the coverage requirements built into Japan's law. How the primary market is designed shapes how easily secondary-market practices can be controlled. Platform regulation still has its own separate space — the StubHub case shows that price-transparency rules can work without waiting for changes in the primary market.

Those three questions are also useful as a quick diagnostic for marketers. An event that limits purchases, ties tickets to identity, and offers an official resale channel gives a more orderly buying experience than one that leaves everything to the open market.

The Regulatory Space Splits Into Three Layers, Each With a Different Cost

As concerts generate economic activity and tax revenue, government becomes a stakeholder in the sector. That revenue alone doesn't create an obligation to regulate ticket resale. What it does create is relevance: as concerts are increasingly positioned as economic activity, the market governance underpinning them enters the policy conversation. Any regulation likely to emerge would pull on one of three levers, and each touches the audience experience at a different point.

Information transparency. A requirement to display the total price upfront, seller identity, whether a ticket is primary or secondary, and terms for returns and transfers. This layer already has a legal basis in Law 8/1999, so it wouldn't need to start from new legislation. It's the lightest-cost option: transparency improves consumer decisions without changing the underlying scarcity.

Allocation rules. Minimum standards for certain categories of events, covering purchase limits per buyer, identity verification, prevention of automated purchasing, and an auditable distribution mechanism. This is the layer with the most influence, since it affects every stage that follows — and it's also the costliest: added operational burden for organizers, slower venue entry, and personal-data processing obligations under Law 27/2022. Purchase limits reduce bulk buying without automatically eliminating resale by professional scalpers, and MTI Singapore's assessment of how hard cross-jurisdictional anti-bot enforcement is applies here too.

Resale price caps. A price ceiling in the secondary market which, based on Victoria's experience, is more likely to work when applied selectively to specific event categories, and after an official resale channel is already in place. Applied broadly without an identity system, price caps risk pushing transactions into closed channels that are harder to monitor.

These three layers solve different problems at different costs. Transparency fixes information without touching allocation. Allocation rules address the root of access while demanding the largest infrastructure. Price caps protect consumers at the point of transaction and depend most heavily on enforcement capacity. This is the range anyone planning investment in this channel over the coming years needs to anticipate.

What Marketers Should Take Away

Conditions in the ticket market shape how audiences experience an event, and that experience is tied to how a sponsoring or partner brand is perceived. There are a few things marketers can weigh before attaching an activation to a concert.

Ticket-market conditions can become part of an event's due diligence. The three primary-market questions — are purchases limited, are tickets tied to buyer identity, and is there an official resale channel — give a picture of how well-organized the ticketing is.

Audience experience also includes the ticket-buying process itself, which typically sits outside a brand's control. Tickets that sell out fast, inflated resale prices, and fraud can produce disappointment that bleeds into the whole event, including the brands involved. PPATK data and YLKI complaints show this kind of disappointment is well documented.

Some brands are already taking this approach. In Indonesia, the myBCA app has served as a sales channel for a number of major concerts, with purchases tied to identity and capped in quantity. Tickets for King Nassar's solo concert at Istora Senayan in November 2026 were sold through myBCA, with buyers required to enter their name, ID number, email, and phone number, and each account capped at a maximum of four tickets, as reported by RRI (2026). For the BIGBANG concert in Jakarta, purchases through myBCA were capped at two tickets per category per email and phone number, as reported by Surabaya Inside (2026). BCA described this channel as a way to make it easier for customers to get tickets (BCA, 2026). This kind of approach places the brand inside the ticket-purchasing process itself, not just around the event's activations.

The rules governing this channel are also changing. The five jurisdictions discussed above are moving on different fronts, and consumer bodies in Indonesia have already flagged the absence of a dedicated legal framework. Long-term partnerships should ideally leave room to adapt if identity verification, purchase limits, or resale channels come under stricter regulation.

Tickets tied to identity also change how audience data is collected. Official channels add a touchpoint with the audience, while at the same time adding personal-data protection obligations under Law 27/2022.

Closing

Ticket scarcity at high-demand concerts creates the incentive for a secondary market to form. That incentive doesn't disappear with a ban, and some resale genuinely benefits consumers. What can be changed is how tickets are sold from the outset, and the rules that apply in the secondary market — and the five jurisdictions discussed show both can be tackled from different angles.

For marketers, there's one more practical shift to note. A concert is usually judged by tickets sold, attendance, economic impact, and tax revenue. Those measures describe the event — they don't describe whether the ticket market behind it is well organized. Yet that's exactly where the audience experience is formed, and where new rules will take effect. Reading the state of the ticket market — through the three questions on purchase limits, identity linkage, and resale channels — adds one thing to a marketer's assessment that sales figures alone don't show: how good an experience audiences will actually take home, and how likely the rules are to change.
